Service Agreement

-Contractor/Client Agreement-

This agreement is made and entered into between:

Full Legal Names:________________________________________

(Hereinafter referred to as “the Client”)

AND

Full Legal Names: Beargrass Lawn Care LLC

(Hereinafter referred to as “the Contractor”) 

The Client hereby authorizes the Contractor to perform lawn care at the following address

according to the scope of work detailed and priced on the Lawn Care Estimate which is attached hereto and forms part of this Lawn Care agreement.

Any additional work required by the Client or proposed by the Contractor which is not defined in this Contractor/Client Agreement shall be quoted separately and when completed added to the invoice.

Beargrass Lawn Care LLC. reserves the right to determine the exact day (s) and time (s) work will be performed, (unless specified).

Obligations

Obligations of the Contractor

1.The Contractor shall provide all labor, equipment and supplies required to perform the services and undertakes to properly maintain all equipment so that work is performed timely and to a professional standard.

2.If the services cannot be carried out by the Contractor on the set day, such a service shall be rescheduled as soon as possible by mutual agreement, the Client will be notified as soon as possible if such a problem were to occur.

3.The contractor shall hold general liability insurance covering the lawn services provided to the customer.

Obligations of the Client

1.The Client need not be present during service calls and hereby grants permission to the Contractor and shall facilitate entry to access the property on scheduled or otherwise agreed service days during the local hours of 8am and 6pm unless specified otherwise.

2.The Client shall be responsible for the removal of ALL foreign objects and debris e.g. toys, furniture, rubbish etc. that will hinder and/or harm the Contractor and his equipment. 

3.If property damage occurs due to a foreign object ejecting from the equipment, The Contractor is not held liable. This does not include natural materials like rocks or pinecones/sticks.

PAYMENT

Payment for services of Beargrass Lawn Care LLC. are due monthly for the prior month of services. Payment is due in full on the 14th of the month unless otherwise stated in the lawn care estimate.

Cancelation of weekly or biweekly mowing services must be given in writing at least two weeks in advance for the cancellation to take effect.

Beargrass Lawn Care LLC . Reserves the right to DISCONTINUE SERVICES DUE TO LATE OR UNPAID BILLS.

Beargrass Lawn Care LLC. Reserves the right to hold and charge a credit card on-file on a monthly basis for services (if the client has selected credit as the preferred form of payment).

Beargrass Lawn Care LLC reserves the right to apply a late fee of $5 or 1%, whichever is greater, for every 7 calendar days a payment is late. If collection efforts are required to collect any unpaid service fees, all expenses incurred will be applied to the delinquent account for reimbursement.

ADDITIONAL AGREEMENT INFORMATION

Beargrass Lawn Care LLC. is NOT responsible to service areas which are not accessible due to locked gates, pets, children, work areas, debris in the work area, litter, lawn ornaments, vehicles, etc. (Re-trip fee will be charged if gate is locked on scheduled arrival date).

Beargrass Lawn Care LLC. will NOT be responsible for damages due to improper installation of Irrigation pipe, wires, cable etc., which are not installed deeper than 3” below ground level near edging surfaces in beds or along cement edges.

Beargrass Lawn Care LLC. is NOT responsible for damages by other parties, personal items left on the lawn or runaway pets.

Beargrass Lawn Care. does NOT act as an agent of the Property- Management or Owner (s).

Beargrass Lawn Care. will replace or pay for any damages (those reported with 48 hrs.) or injuries due by neglect in mowing service activity, directly related to Beargrass Lawn Care LLC’s maintenance operation within a timely manner.

Beargrass Lawn Care LLC. is NOT responsible for delays or damages caused by acts of God or events beyond its control, vandalism or improper operations of systems not under our maintenance.
